Kanun, zorlay\u0131c\u0131 sebeplerin mevcudiyeti halinde i\u015f\u00e7i ve i\u015fverene hakl\u0131 nedenle fesih imkan\u0131 tan\u0131m\u0131\u015ft\u0131r. \u015e\u00f6yle ki;<\/li>\n<\/ul>\n<p>\u0130\u015f\u00e7i a\u00e7\u0131s\u0131ndan,<\/p>\n<p>4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun (\u2018\u2019<b>Kanun<\/b>\u2019\u2019) 24\u2019\u00fcnc\u00fc maddesi III bendine g\u00f6re, <i>i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015f yerinde bir haftadan fazla s\u00fcre ile i\u015fin durmas\u0131n\u0131 gerektirecek zorlay\u0131c\u0131 sebepler ortaya \u00e7\u0131karsa <\/i>i\u015f\u00e7i i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilir.<\/p>\n<p>\u0130\u015fveren a\u00e7\u0131s\u0131ndan,<\/p>\n<p>Kanun\u2019un 25\u2019inci maddesi III bendine g\u00f6re, <i>i\u015f\u00e7iyi i\u015f yerinde bir haftadan fazla s\u00fcre ile \u00e7al\u0131\u015fmaktan al\u0131koyan zorlay\u0131c\u0131 bir sebebin ortaya \u00e7\u0131kmas\u0131 halinde <\/i>i\u015fveren i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle feshedebilir.<\/p>\n<p>Kanun\u2019un 40\u2019\u0131nc\u0131 maddesi;<\/p>\n<p><i>\u2018\u201924 ve 25 inci maddelerin (III) numaral\u0131 bentlerinde g\u00f6sterilen zorlay\u0131c\u0131 sebepler dolay\u0131s\u0131yla \u00e7al\u0131\u015famayan veya \u00e7al\u0131\u015ft\u0131r\u0131lmayan i\u015f\u00e7iye bu bekleme s\u00fcresi i\u00e7inde bir haftaya kadar her g\u00fcn i\u00e7in yar\u0131m \u00fccret \u00f6denir.\u2019\u2019 <\/i>\u015feklinde olup, zorlay\u0131c\u0131 neden dolay\u0131s\u0131yla \u00e7al\u0131\u015ft\u0131r\u0131lamayan i\u015f\u00e7iye bu bekleme s\u00fcresi i\u00e7inde bir haftaya kadar her g\u00fcn i\u00e7in yar\u0131m \u00fccret \u00f6denece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bir haftal\u0131k ask\u0131 s\u00fcresinde i\u015f akdi sonland\u0131r\u0131lamaz.<\/p>\n<p>Bir haftal\u0131k s\u00fcre sonras\u0131nda ise, i\u015f\u00e7i veya i\u015fverenin i\u015f s\u00f6zle\u015fmesini feshetme hakk\u0131 vard\u0131r. \u0130\u015fverenin i\u015f s\u00f6zle\u015fmesini feshi halinde i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6demesi yapmas\u0131 gerekecektir. Taraflar i\u015f s\u00f6zle\u015fmesini feshetmez ise, s\u00f6zle\u015fmenin ask\u0131 hali devam edecek ve zorlay\u0131c\u0131 neden ortadan kalk\u0131ncaya kadar \u00fccret \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ortadan kalkacakt\u0131r.<\/p>\n<ol start=\"2\">\n<li><b><\/b><b>\u0130\u015fverenler Koronavir\u00fcs salg\u0131n\u0131 nedeniyle i\u015fyerini kapatabilir<\/b><b> <\/b><b>mi?<\/b><\/li>\n<\/ol>\n<ul>\n<li>\u0130\u015fverenler, i\u015fyerinde 6331 Say\u0131l\u0131 Kanun gere\u011fi i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerini almak zorundad\u0131r. Bu \u00e7er\u00e7evede \u00e7al\u0131\u015fanlar\u0131n\u0131n aras\u0131ndaki sosyal mesafeyi ayarlamak, gerekli hijyen tedbirlerini almak gibi t\u00fcm hususlara dikkat etmesi gerekecektir. \u00dcretim alan\u0131nda \u00e7al\u0131\u015fan i\u015f\u00e7ilerin mevcudiyeti halinde, \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Uzman\u0131\u2019ndan bu konuda bir rapor almak kayd\u0131yla i\u015fverenler i\u015fyerini kapatabilecektir. Bu durumda i\u015fveren taraf\u0131ndan yap\u0131lan fesih, i\u015fletmenin kapat\u0131lmas\u0131 sebebiyle \u0130\u015f Kanunu 18\u2019inci maddesi gere\u011fi ge\u00e7erli neden te\u015fkil edecektir.<\/li>\n<\/ul>\n<ol start=\"3\">\n<li><b><\/b><b>65 ya\u015f ve \u00fczeri \u00e7al\u0131\u015fanlar\u0131n i\u015f akdi feshedilebilir<\/b><b> <\/b><b>mi?<\/b><\/li>\n<\/ol>\n<ul>\n<li>Koronavir\u00fcs salg\u0131n\u0131 nedeniyle 65 ya\u015f \u00fcst\u00fc vatanda\u015flar\u0131m\u0131z\u0131n soka\u011fa \u00e7\u0131kma yasa\u011f\u0131 dolay\u0131s\u0131yla \u00e7al\u0131\u015famamalar\u0131 hali, Kanun \u00e7er\u00e7evesinde zorlay\u0131c\u0131 sebep olarak de\u011ferlendirilebilecektir. Bu s\u00fcre\u00e7te i\u015f s\u00f6zle\u015fmeleri ask\u0131 halinde olarak de\u011ferlendirilecektir. \u00c7al\u0131\u015f\u0131lamayan bir haftal\u0131k s\u00fcre i\u00e7in yar\u0131m \u00fccret \u00f6demesi yap\u0131lmas\u0131 gerekecektir. \u0130\u015f\u00e7inin i\u015f akdini sonland\u0131rmak istemeyen i\u015fverenler, y\u0131ll\u0131k \u00fccretli izin, \u00fccretsiz izin gibi uygulamalar\u0131n \u00f6ncelikli olarak uygulayabilir. Aksi halde bir haftal\u0131k s\u00fcre sonras\u0131nda, i\u015f\u00e7iye k\u0131dem tazminat\u0131 \u00f6denerek, Kanun\u2019un 25\/III h\u00fckm\u00fc gere\u011fi i\u015f akdi sonland\u0131r\u0131labilecektir.<\/li>\n<\/ul>\n<ol start=\"4\">\n<li><b><\/b><b>Y\u0131ll\u0131k \u00fccretli izin ve \u00fccretsiz izin uygulamas\u0131 i\u015fverence belirlenebilir<\/b><b> <\/b><b>mi?<\/b><\/li>\n<\/ol>\n<p>\u27a2Y\u0131ll\u0131k \u00fccretli izin anayasal dinlenme hakk\u0131d\u0131r. Ancak, y\u0131ll\u0131k \u00fccretli iznin hangi tarihlerde ne kadar s\u00fcre ile kulland\u0131r\u0131laca\u011f\u0131 i\u015fverenin y\u00f6netimkapsam\u0131ndad\u0131r.<\/p>\n<p>Y\u0131ll\u0131k \u00dccretli \u0130zin Y\u00f6netmeli\u011fi\u2019nin 10\u2019uncu maddesinde; \u2018<i>\u2019\u0130\u015fveren veya i\u015fveren vekili Nisan ay\u0131 ba\u015f\u0131 ile Ekim ay\u0131 sonu aras\u0131ndaki s\u00fcre i\u00e7inde, i\u015f\u00e7ilerin t\u00fcm\u00fcn\u00fc veya bir k\u0131sm\u0131n\u0131 kapsayan toplu izin uygulayabilir.\u2019\u2019 <\/i>\u015feklinde ifade edilmi\u015f olup, i\u015fverenler i\u015fyerinde toplu izin uygulayabilecektir.<\/p>\n<p>\u0130\u015f\u00e7ilerin y\u0131ll\u0131k \u00fccretli izni mevcut de\u011filse, i\u015f\u00e7iye \u00fccretsiz izin uygulamas\u0131 teklif edilebilir. \u0130\u015f\u00e7i \u00fccretsiz izin uygulamas\u0131n\u0131 kabul eder ise, i\u015fveren bu s\u00fcre\u00e7te \u00fccret ve SGK prim \u00f6demesi yapmayacakt\u0131r. \u0130\u015f\u00e7i, \u00fccretsiz izin teklifini kabul etmez ise, i\u015fveren Kanun\u2019un ge\u00e7erli nedenle fesih h\u00fck\u00fcmleri uyar\u0131nca k\u0131dem ve ihbar \u00f6demesi yap\u0131larak i\u015f akdini sonland\u0131rabilecektir.<\/p>\n<ol start=\"5\">\n<li><b><\/b><b>\u0130\u015fyerinde<\/b><b> <\/b><b>Koronavir\u00fcs<\/b><b> <\/b><b>te\u015fhisi<\/b><b> <\/b><b>konulmu\u015f<\/b><b> <\/b><b>\u00e7al\u0131\u015fan<\/b><b> <\/b><b>var<\/b><b> <\/b><b>ise,<\/b><b> <\/b><b>i\u015fverenler<\/b><b> <\/b><b>nas\u0131l<\/b><b> <\/b><b>bir<\/b><\/li>\n<\/ol>\n<p><b>yol izleyebilir?<\/b><\/p>\n<ul>\n<li>\u0130\u015fyerinde Koronavir\u00fcs te\u015fhisi konulan \u00e7al\u0131\u015fan\u0131n, \u00e7al\u0131\u015fmas\u0131na devam etmesi beklenemeyece\u011finden, Kanun\u2019un 25\/III h\u00fckm\u00fc uyar\u0131nca k\u0131dem tazminat\u0131 \u00f6demesi yap\u0131larak i\u015fverence fesih yap\u0131labilecektir.<\/li>\n<\/ul>\n<ol start=\"6\">\n<li><b><\/b><b>\u0130\u015fveren, i\u015f\u00e7ileri i\u015fyerine yak\u0131n bir yerde konaklamaya zorlayabilir<\/b><b> <\/b><b>mi?<\/b><\/li>\n<\/ol>\n<ul>\n<li>\u0130\u015fyerinde \u00fcretim devam ediyor veya \u00e7al\u0131\u015fma var ise, i\u015fyerine yak\u0131n yerde konaklaman\u0131n gerekli oldu\u011funa ili\u015fkin \u0130\u015f G\u00fcvenli\u011fi Uzman\u0131ndan bir rapor al\u0131nmas\u0131 gerekmektedir. Bu \u00e7er\u00e7evede, i\u015fveren i\u015f\u00e7ileri i\u015fyeri yak\u0131n\u0131nda konaklamaya zorlayabilir. Buna gerek\u00e7e olarak, toplu ta\u015f\u0131mayla i\u015fyerine gelen i\u015f\u00e7ilerin ve di\u011fer \u00e7al\u0131\u015fma arkada\u015flar\u0131n\u0131n salg\u0131ndan etkilenebilecek olmas\u0131 g\u00f6sterilebilecektir.<\/li>\n<\/ul>\n<ol start=\"7\">\n<li><b><\/b><b>\u015eantiye sahas\u0131nda Koronavir\u00fcs semptomlar\u0131 g\u00f6steren bir i\u015f\u00e7inin Koronavir\u00fcs testi pozitif \u00e7\u0131kt\u0131 ise, \u00e7al\u0131\u015fma arkada\u015flar\u0131n\u0131n karantinaya al\u0131nmas\u0131 gerekecek<\/b><b> <\/b><b>midir?<\/b><\/li>\n<\/ol>\n<ul>\n<li>Evet. Ayr\u0131ca 14 g\u00fcnl\u00fck karantina s\u00fcresi i\u015f\u00e7inin y\u0131ll\u0131k izninden mahsup<\/li>\n<\/ul>\n<p>edilemeyecektir. Ayr\u0131ca bu s\u00fcre\u00e7te i\u015f\u00e7inin \u00fccretinin \u00f6denmesi gerekecektir.<\/p>\n<ol start=\"8\">\n<li><b><\/b><b>\u0130\u015f\u00e7inin i\u015fyerinde Koronavir\u00fcs\u2019e yakalanmas\u0131, i\u015f kazas\u0131 te\u015fkil edecek<\/b><b> <\/b><b>midir?<\/b><\/li>\n<\/ol>\n<p>\u27a2Yarg\u0131tay 21. Hukuk Dairesi\u2019nin i\u015f kazas\u0131 ile ilgili uygulamalar\u0131 geni\u015f bir \u00e7er\u00e7evede de\u011ferlendirmektedir. Bu \u00e7er\u00e7evede Koronavir\u00fcs salg\u0131n\u0131 da i\u015f kazas\u0131 olarak de\u011ferlendirilebilecektir. Ancak il sa\u011fl\u0131k m\u00fcd\u00fcrl\u00fckleri, pandemi sebebiyle hasta olan \u015fah\u0131slar\u0131n kay\u0131tlar\u0131n\u0131 ve bu ki\u015filerin kimlerle temas etti\u011fine ili\u015fkin kay\u0131tlar\u0131 tutmaktad\u0131r. E\u011fer hastal\u0131k halinin i\u015f\u00e7inin kendi \u00e7evresinden kaynakland\u0131\u011f\u0131 ispatlan\u0131rsa, nedensellik ba\u011f\u0131n\u0131n kesildi\u011finden bahisle i\u015fverenin sorumlulu\u011fu s\u00f6z konusuolmayacakt\u0131r.<\/p>\n<ol start=\"9\">\n<li><b><\/b><b>\u0130\u015f\u00e7i evden \u00e7al\u0131\u015f\u0131rken Koronavir\u00fcs hastal\u0131\u011f\u0131na yakalan\u0131rsa i\u015fverenin sorumlulu\u011fu ne<\/b><b> <\/b><b>olacakt\u0131r?<\/b><\/li>\n<\/ol>\n<ul>\n<li>\u0130\u015f\u00e7inin yak\u0131n \u00e7evresinden bu hastal\u0131\u011fa yakaland\u0131\u011f\u0131 tespit edilir, i\u015fverenle ilgili nedensellik ba\u011f\u0131 kesilir ise i\u015fverenin sorumlulu\u011fu do\u011fmayacakt\u0131r.<\/li>\n<\/ul>\n<ol start=\"10\">\n<li><b><\/b><b>\u0130\u015fveren t\u00fcm \u00f6nlemleri almas\u0131na ra\u011fmen i\u015fe fiilen gelen i\u015f\u00e7i Koronavir\u00fcs\u2019e yakalan\u0131rsa bunun sonu\u00e7lar\u0131 ne<\/b><b> <\/b><b>olacakt\u0131r?<\/b><\/li>\n<\/ol>\n<ul>\n<li>Yarg\u0131tay 21. Bir haftadan sonraki s\u00fcre\u00e7 i\u00e7in ise, i\u015f akdinin zorlay\u0131c\u0131 nedenle (Kanun\u2019un 25\/III h\u00fckm\u00fc uyar\u0131nca) feshi s\u00f6z konusu olabilecektir.<\/li>\n<\/ul>\n<p><b> 13. <\/b><b>Pandemi halinin sonlanmas\u0131 ile birlikte i\u015fveren i\u015fyerini a\u00e7ar, i\u015f\u00e7i i\u015fe gelmez ise i\u015fveren nas\u0131l bir yol<\/b><b> <\/b><b>izleyebilir?<\/b><\/p>\n<ul>\n<li>Bu halde i\u015fveren a\u00e7\u0131s\u0131ndan Kanun\u2019un 25\/II\/g h\u00fckm\u00fc gerek\u00e7e g\u00f6sterilerek ve \u015fekil \u015fartlar\u0131na uymak kayd\u0131yla <i>(devams\u0131zl\u0131k tutanaklar\u0131 tutularak ve ihtarname g\u00f6nderilerek) <\/i>devams\u0131zl\u0131k nedeniyle hakl\u0131 nedenle fesih imkan\u0131 do\u011facakt\u0131r.<\/li>\n<\/ul>\n<ol start=\"14\">\n<li><b><\/b><b>\u0130\u015fveren i\u015fyerini a\u00e7t\u0131ktan sonra i\u015f\u00e7i i\u015fyerine gider, ancak i\u015fveren i\u015fi fiilen ba\u015flatmaz ise i\u015f s\u00f6zle\u015fmesinin ak\u0131beti ne<\/b><b> <\/b><b>olacakt\u0131r?<\/b><\/li>\n<\/ol>\n<ul>\n<li>\u0130\u015fverenin i\u015fyerini a\u00e7mas\u0131 ile birlikte fiili ask\u0131 durumu kalkm\u0131\u015f say\u0131lacakt\u0131r. \u0130\u015fveren i\u015f\u00e7iyi i\u015fe ba\u015flatmaz ise o tarih itibariyle fesih s\u00f6z konusu olaca\u011f\u0131ndan, i\u015f\u00e7i i\u015fe iade davas\u0131 a\u00e7abilecektir. Bu \u00e7er\u00e7evede i\u015f\u00e7iye k\u0131dem tazminat\u0131 ve ihbar tazminat\u0131 \u00f6demeleri yap\u0131lmas\u0131 gerekebilecektir.<\/li>\n<\/ul>\n<ol start=\"15\">\n<li><b><\/b><b>\u0130\u015fveren k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011finde ba\u015fvurmay\u0131p, \u00e7al\u0131\u015fma s\u00fcresinin k\u0131salt\u0131lmas\u0131 veya \u00fccret indirimi uygulamalar\u0131na gidebilir<\/b><b> <\/b><b>mi?<\/b><\/li>\n<\/ol>\n<ul>\n<li>\u0130\u015fverenin \u00e7al\u0131\u015fma s\u00fcresinin k\u0131salt\u0131lmas\u0131 veya \u00fccret indirimi uygulamalar\u0131na gidilmesi Kanun\u2019un 22. maddesi gere\u011fi \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 de\u011fi\u015fiklik kapsam\u0131nda de\u011ferlendirilecektir. Bu \u00e7er\u00e7evede i\u015f\u00e7inin de\u011fi\u015fikli\u011fe ili\u015fkin yaz\u0131l\u0131 onay\u0131n\u0131n al\u0131nmas\u0131 gerekecektir.<\/li>\n<\/ul>\n<ol start=\"16\">\n<li><b><\/b><b>\u0130\u015f\u00e7i, \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 de\u011fi\u015fikli\u011fi kabul etmez ise, i\u015fverence yap\u0131lan fesih ge\u00e7erli neden te\u015fkil eder<\/b><b> <\/b><b>mi?<\/b><\/li>\n<\/ol>\n<ul>\n<li>\u0130\u015fveren k\u0131sa \u00e7al\u0131\u015fma uygulamas\u0131na ge\u00e7i\u015f yerine \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 de\u011fi\u015ftirme karar\u0131 al\u0131r ve i\u015f\u00e7i bu karar\u0131 kabul etmez ise yap\u0131lan fesih, feshin son \u00e7are olmas\u0131 ilkesine ayk\u0131r\u0131l\u0131k te\u015fkil edecektir.
